Article 6-Product delivery
6.1 General conditions
The products ordered by the purchaser,are delivered to the delivery address given by the purchaser("delivery address").
The products are sent together with a receipt and if a purchase invoice is requested,it is sent by email to the address indicated at the moment of registration on Backstage site and also on paper with the shipping of the article.
6.2 Delivery terms for Italy
The transport manager delivers the order to the buyer or to the addressee and asks him to sign an electronic receipt proving the delivery of the products ordered to Backstage.
The delivery is done during working days ( from Mondays to Fridays ).If the buyer or the addressee is absent ,he receives a failed delivery notice ,with the address of the deliverer to contact for a second delivery.The order can be delivered to a third person if it is expressly stated by the buyer.
If the deliverer is not contacted,he comes back within 2 working days ,after his first passage.In case of 2 failed attempts to deliver the parcel ,the buyer or the addressee receives a notice with the address of the place where the order is kept for 6 working days.The buyer or the addressee collects the parcels there.At the expiration of the time limit ,the parcel is given back to Backstage and the purchaser has a refund with terms chosen by Backstage , and minus the delivery fees.
No delivery claim concerning the parcel is accepted.The carrier's computer system (flash-age)attests the delivery.
6.3 . Delivery terms for foreign countries
The parcel is delivered to the delivery address.
If the letter box is too small,the parcel is directly delivered to the buyer's home or to another person convenient to the addressee and specifically stated by proxy.
If the parcel cannot be delivered because of the size of the letter box and/or because the addressee is absent,a failed delivery notice is given to the customer to withdraw the parcel at the post office within 10 working days.
After this period ,the parcel is given back to the sender. In this case,the buyer has a refund calculated by Backstage who also deduces the delivery fees.
No delivery claim concerning the parcel is accepted.The carrier's computer system attests the delivery.
6.3.1 Some countries may be subject to customs fees and import duties. Such fees and expenses are full paid by the recipient.
6.4 Product defects, non conformity and damage
6.4.1 General terms
All the products sold by Backstage are covered by the producer's standard warranty,and for the customer(who purchases the goods as a foreign entrepreneur or as a professional or without VAT reference)also by the legal warranty for non conformity,articles 128-135.D.Lgs.n.206/2005.
To benefit from this warranty,the customer has to keep the receipt and/or the invoice sent to him.
The producer standard warranty is provided according to the terms written in the leaflet inside the product packaging .If after the intervention of the authorized assistance centre,the defects end up not being covered by the warranty,the customer is charged with the checking costs and restoration requested by the assistance centre,and also the transport costs if paid by Backstage.
The legal guarantee for the customer covers the conformity defects seen at delivery and within 2 years after.Conformity defects have to be submitted ASAP and within 2 months.The claims against the seller have to be submitted before a period of 26 months after delivery.In case of non conformity,the customer benefits from free restoration,reparation or change,and a reduction adequate to the price or to the termination of the contract,art.130 D.lgs.n.206/2005.Between 2 months after the discovery of the defect and before 26 months maximum,the buyer has to send his claim(to download on the site,section Right of Withdrawal)to Backstage via Perugia 1 47838 RICCIONE (Rimini)Italy ,or by fax 0541 602036.Backstage customer service contacts the customer for the formalities and the return number to join with the product.Backstage sends a letter to withdraw the product ,free of charge.The entire product has to be restored in its packaging of origin(including leaflet and accessory:manuals,cables,and so on).Please do not tag or put rubber directly on the product.After checking,Backstage changes or repairs and sends the product-art.130 D.Lgs.n.206/2005.If after the intervention of the assistance centre ,the defects end up not being covered by warranty,the customer is charged with checking costs and restoration requested by centre and also transport costs.
6.4.2 Procedures to follow in case of damaged parcel
If a damage is noted in the presence of transport manager,the parcel is refused and a detailed letter stating the reasons for refusal is written ,a form joined to the receipt is filled in.
6.4.3 Procedures in case of missing,damaged or non conformity products
The buyer or the addressee reports the missing product ,defect,non conformity or damage .
Backstage can check information-concerning the buyer's or addressee's identity-and other relevant details.Backstage explains to them the procedures to send back damaged products or to obtain missing products.
When Backstage receives the products,B.checks defect,damage or non conformity with description on site.If it is effectively the case and in conformity with art.130,Consumers'Code,B.changes and sends products ASAP (free of charge). If B.is unable to change products,B.immediately send email to the buyer via his electronic address given at Log In and gives a refund of product and delivery fees to give back products.Please keep receipts of delivery fees.The refund is done by B.in the shortest terms.
If after examination B.considers products conform,not damaged or in conformity with description on site ,the refund is refused and products are given back to the buyer.
6.5 Delivery time and costs
Delivery time for Italy varies from 3 to 5 working days-the reference being the Italian Calendar-
Delivery to Sicily & Sardinia can take 1 or 2 more working days.
